Terms & Conditions – Moji Wholesale

By accessing our website, creating an account, or placing an order with Moji Wholesale, you agree to the following Terms & Conditions.

1. Business-to-Business Sales Only

Moji Wholesale sells exclusively to licensed businesses. By placing an order, you confirm that you are a registered business and authorized to purchase and resell regulated products.

2. Age-Restricted Products

Products sold by Moji Wholesale may include tobacco, vapor, nicotine, and other age-restricted products. All purchasers are responsible for complying with all applicable federal, state, and local laws.

3. Customer Compliance Responsibility

Customers are responsible for ensuring that all products purchased from Moji Wholesale are legal for resale in their jurisdiction. Moji Wholesale is not responsible for any unlawful resale, marketing, possession, or misuse of products by customers or end users.

4. PACT Act & Shipping Compliance

Due to PACT Act requirements, Moji Wholesale ships only to verified businesses at registered business locations. We do not ship restricted products to residential addresses.

5. Order Inspection

Customers must inspect all orders upon delivery. Any shortages, damages, incorrect items, or discrepancies must be reported within 24 hours of receiving the order. Claims submitted after this period may be denied.

6. Returns & Refunds

All sales are final. Disposable vape products are non-returnable under any circumstances. Returns are accepted only if the customer receives an incorrect product that was not ordered.

All returns must be pre-approved and issued a Return Merchandise Authorization (RMA#). Returns without an RMA# will not be accepted. Approved returns are eligible for store credit only. No cash refunds will be issued. A 25% restocking fee may apply to approved returns.

7. Payment Terms

All invoices must be paid according to the agreed payment terms. Failure to pay may result in account suspension, order holds, collection activity, and/or legal action.

8. Collection Costs

The customer agrees to be responsible for any costs related to collection of unpaid balances, including attorney fees, court costs, filing fees, and collection agency fees where permitted by law.

9. Product Disclaimer

Moji Wholesale is a distributor of third-party products and does not manufacture the products sold. Products are provided “as is” without warranties of any kind. Moji Wholesale makes no representation regarding product safety, labeling, performance, or manufacturer claims.

10. Trademarks & Brand Ownership

All product names, trademarks, logos, and images are the property of their respective owners. Their use is for identification purposes only and does not imply any affiliation, sponsorship, cooperation, or endorsement by the brand owners.

11. FDA Disclaimer

Certain products sold by Moji Wholesale may not have been evaluated by the Food and Drug Administration and are not intended to diagnose, treat, cure, or prevent any disease or condition.

12. California Proposition 65 Warning

13. Nitrous Oxide Products

Products containing nitrous oxide are sold strictly for lawful food-grade and culinary use only, such as whipped cream preparation. Any misuse, including intentional inhalation, is strictly prohibited and may cause serious injury or death.

By purchasing nitrous oxide products, the customer confirms that possession, resale, and use will comply with all applicable laws and will be limited to lawful food preparation purposes only. Moji Wholesale assumes no liability for misuse or unlawful use.

14. Limitation of Liability

Moji Wholesale shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from the purchase, resale, possession, misuse, or distribution of products.

15. Account Suspension or Termination

Moji Wholesale reserves the right to refuse service, cancel orders, suspend accounts, or terminate access for any customer who violates these Terms & Conditions, provides false information, fails to pay, or violates applicable laws.

16. Changes to Terms

Moji Wholesale reserves the right to update or modify these Terms & Conditions at any time. Continued use of our website or services constitutes acceptance of the updated terms.
